2011 Workplace Trends
The President (through Executive Orders), Congress (think health care reform), the National Labor Relations Board, the Department of Labor and other government agencies have made significant labor-related changes that affect every employer. Are your policies and practices in compliance? We will cover what has happened, what is about to happen, and what employers need to do now as part of their 2011 action plan.

Lilly Ledbetter Fair Pay Act
The Lilly Ledbetter Fair Pay Act, once viewed as a narrow legislative change with limited impact, is presenting difficult and far-reaching challenges for employers large and small. The Act resets the time period for bringing pay discrimination claims each time an individual is affected by the application of an alleged unlawful compensation decision or practice. The litigation window is now open to a variety of novel claims relating to every aspect of a company’s day-to-day human resources practices. We will cover the scope of the Ledbetter Fair Pay Act, other legislative changes impacting fair pay litigation, and the preventive strategies your organization can take to minimize and defend claims.
FLSA
This session will highlight problematic pay practices that have been used as the basis for wage and hour claims and will provide effective strategies for helping your company avoid being the next target of such claims.
GINA
On November 9, 2010, the Equal Employment Opportunity Commission (EEOC) issued Final Regulations to implement the employment provisions (Title II) of GINA. The Final Regulations were effective January 8, 2011. In light of the new obligations imposed by the Final Regulations employers should review their practices/procedures in connection with requesting (or requiring) employees to provide medical information or submit to employment-related medical examinations and make appropriate adjustments to comply with GINA. We will cover what GINA requires and what employers need to know to be in compliance.
Immigration
In 2008, South Carolina passed the South Carolina Illegal Immigration Reform Act (“SCIIRA”), S.C. Code Ann. §41-8-10, et seq., effective 2009. We will cover the impact SCIIRA has had on South Carolina businesses since its effective date, trends seen in its enforcement, and tips employers can use to protect themselves.
